DMCA Policy
Purecast respects intellectual property rights and complies fully with the Digital Millennium Copyright Act (DMCA). This page explains how to submit a valid copyright infringement notice and what happens next.
Overview & Our Position
Purecast ("we," "us," or "our") is committed to operating in full compliance with applicable copyright laws, including the Digital Millennium Copyright Act (DMCA) of the United States and equivalent Canadian legislation under the Copyright Act (R.S.C., 1985, c. C-42).
We take copyright infringement seriously. If you believe that content made available through our service infringes upon a copyright that you own or control, we encourage you to notify us immediately using the process described on this page.
Upon receipt of a compliant DMCA takedown notice, we will act expeditiously to remove or disable access to the allegedly infringing material, and we will notify the affected user where legally appropriate.
Designated DMCA Agent
All DMCA-related notices and correspondence must be directed to our designated copyright agent. We have appointed the following contact to receive and process all copyright infringement claims:
Purecast Copyright Agent
Please address all notices to our legal compliance team using the information below. Notices sent to any other address may not be received or processed in a timely manner.
How to File a Notice
To file a copyright infringement notice with Purecast, please send a written communication to our designated DMCA agent (see Section 02 above). Your notice must be submitted in writing — either by email or physical mail — and must include all elements described in Section 04.
We recommend submitting your notice by email for the fastest possible response. Please use the subject line format: "DMCA Takedown Notice – [Your Name / Company]" to ensure your message is routed to our legal team immediately.
- Prepare all required information listed in Section 04 before contacting us
- Send your notice to [email protected] with the subject "DMCA Takedown Notice"
- Include your electronic or physical signature
- Wait for our acknowledgement email — typically within 48 business hours
- We will confirm the action taken once we have reviewed your notice
Notice Requirements
To be considered valid under the DMCA (17 U.S.C. § 512(c)(3)), your written notice must include all of the following elements. Incomplete notices may be rejected or delayed.
- Identification of the copyrighted work. A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notice, a representative list of such works.
- Identification of the infringing material. A description of the material you claim is infringing and information sufficient for us to locate that material — such as a URL, channel name, or specific content identifier.
- Your contact information. Your full legal name, mailing address, telephone number, and email address so we can respond to your notice.
- Good faith statement. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement. A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
- Signature. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Counter- Notification
If you believe that content you submitted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated DMCA agent. A valid counter-notification under 17 U.S.C. § 512(g)(3) must contain the following:
- Your physical or electronic signature
- Identification of the removed material and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your full name, address, and telephone number
- A statement that you consent to jurisdiction of the Federal District Court for your district, or if outside the US, any judicial district in which Purecast may be found
Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and may restore the removed content within 10–14 business days, unless the copyright owner files a court action to prevent the restoration.
Repeat Infringer Policy
In accordance with the DMCA and our commitment to protecting intellectual property, Purecast maintains a strict policy regarding repeat infringers.
We reserve the right, at our sole discretion, to terminate any user's account or access to our service at any time, with or without notice, for any copyright-related violations — including but not limited to:
- Unauthorized distribution of copyrighted content
- Circumvention of digital rights management (DRM) measures
- Recording, re-streaming, or redistributing our licensed content
- Sharing login credentials to enable unauthorized access
- Any other activity that violates copyright law or our Terms of Service
Abuse & False Claims
Purecast takes the misuse of the DMCA process very seriously. Filing false or fraudulent DMCA notices is not only a violation of our policies but also a federal offense under United States law and may be subject to civil and criminal penalties.
If we determine that a DMCA notice has been filed in bad faith, is fraudulent, or is being used as a tool of harassment or anti-competitive behavior, we reserve the right to:
- Reject the notice without further action
- Report the abusive filer to appropriate legal authorities
- Pursue legal remedies including recovery of attorneys' fees and damages
- Notify the affected user of the false claim made against them
We encourage all rights holders to conduct thorough due diligence before filing a DMCA notice and to only submit notices for content they have a genuine, good-faith belief is infringing.
